1. ACCEPTANCE OF TERMS

By hiring our services or subscribing to our plans, you agree to these Terms and Conditions established by D'Sell Marketing ("the Agency," "we," "us"), based in Fort Lauderdale, Florida, USA.

2. SERVICES PROVIDED

D'Sell Marketing offers digital solutions including:

- Lead funnels.

- Automated follow-up systems (email, SMS, WhatsApp, phone calls, voicemail drops).

- Automated review generation.

- Centralized communication inbox (Messenger, Email, SMS, Webchat, Google Messaging, etc.).

- On-site webchat widget and CRM platform.

- Lead generation ad campaign creation and management.

- AI-powered virtual agent to answer leads automatically.

3. PLANS AND PAYMENTS

- Monthly Subscriptions: Subscription-based services are billed on a recurring basis. Some offers may include a free trial period (7, 14, or 30 days).

- One-Time Projects: Require full upfront payment before the project begins.

- Accepted Payment Methods: Credit/debit card and Zelle.

- Refund Policy: Refunds are only available for specific products or offers that explicitly state a refund guarantee.

4. INTELLECTUAL PROPERTY

- All content created is owned by the client once full payment is received.

- D'Sell Marketing is not responsible for licensing third-party assets such as music, images, or videos. The client is responsible for providing or authorizing any such content.

5. CANCELLATION AND RENEWAL

- Clients may cancel their subscriptions at any time by emailing [email protected].

- For faster processing, cancellation follow-up may be done via SMS or call to +1 754-663-3294.

- Subscriptions automatically renew unless otherwise stated.

- There are no penalties for early cancellation.

6. DATA STORAGE

- Campaign data, leads, and CRM records are stored only while the client's account remains active.

- Once a service is canceled, data storage and access will be deactivated.

7. GUARANTEES AND LIMITATION OF LIABILITY

- Some services may include a guaranteed minimum number of leads, as specified in the individual offer or proposal.

- No guarantee is made regarding sales, followers, or specific financial outcomes.

- The Agency is not liable for disruptions caused by third-party platforms (Meta, Google, etc.).

8. CONFIDENTIALITY

- Although NDAs are not signed by default, we treat all client information with strict confidentiality and use it solely for service delivery purposes.

9. MODIFICATIONS

D'Sell Marketing reserves the right to update these Terms at any time. Active clients will be notified via email at least 7 days prior to any major changes.

10. GOVERNING LAW

This agreement shall be governed by the laws of the State of

Florida, USA. Any disputes shall be exclusively resolved in the courts located in

Broward County, Florida.
